A pizza delivery company is trying to convince consumers to eat more pizza after the pizza chain was hit with a federal lawsuit claiming that the company is in violation of the Affordable Care Act.
In a lawsuit filed in U.S. District Court for the District of Columbia, Domino’ Pizza claims that it has failed to provide affordable coverage to employees under its Obamacare plans because it does not have enough workers to process orders.
In addition, the company claims that the employer’s lack of an adequate health insurance plan violates the ACA.
In response to the lawsuit, Dominics Pizza has said that it “strongly disagrees” with the allegations in the lawsuit and has said it has worked with state attorneys general to provide workers with health insurance through an expansion of state exchanges.
Dominos CEO Steve Feinberg told the Wall Street Journal that the pizza company has “worked with our employees and their representatives to provide health care coverage and the ability to pay for our employees’ premiums and other benefits.”
He added that the legal process has been ongoing since last November and that the federal government is still working with the company to resolve the matter.
The lawsuit was filed on behalf of a Domino Foods employee who has been on the Obamacare exchange for about three months, according to the WSJ.
The employee has not been paid for the full month of enrollment because he has not yet filed his federal income tax return, and he says he is owed money for past months’ premiums, which totaled $1,934, according a news release.
The federal lawsuit is the latest to be filed against Dominos.
Last week, the Justice Department announced a settlement with the pizza giant over a separate lawsuit brought by an employee who claimed that the chain violated the ACA by not providing employees with sufficient health insurance.
The settlement requires Dominos to provide up to 50 percent of its employees with health coverage through an exchange starting in 2018.
In December, Dominos agreed to pay $3.6 million to settle a federal class action lawsuit brought against the company by a former employee.
In that case, a former Domino employee claimed that he was terminated from the company for not meeting a number of eligibility requirements.
Domino denied the allegations, saying that employees are eligible for coverage through their employers, and that employees can also enroll in a health plan through the federal exchange.
